Initial Term: 1 Month

Please note that unless you properly cancel the Agreement, upon expiration of the Initial Term, the Agreement will continue to automatically renew on a month-to-month basis (each 30-day period, a “Renewal Term”). By entering into this Agreement, you expressly consent to automatic renewal as described in the Terms of Service. The Initial Term, and any and all Renewal Terms, shall be collectively referred to as the “Term” of your Agreement.

TERMS OF RECURRING DUES MEMBERSHIP

This monthly payment and the allocation of treatments will automatically recur each month until Member properly cancels.

BILLING DATE

Member agrees that the first installment of $[RecurringFee] will be due on the date which The NOW™ Boutique Location first opens for business (the “Grand Opening Date”). Each subsequent installment will be due on the same day as the Grand Opening Date each month thereafter and will continue for the duration of the Term. 

OTHER FEES AND CHARGES

Return Item Fee: $25 charged immediately for any check, draft, credit card or order returned for insufficient funds or any other reason.

No Show; Late Cancel Fee: 50% of the session value. See Terms of Service for more details.

Operation of The NOW Boutique location listed on the first page of the Agreement will be subject to the North Carolina Massage and Bodyworks Therapy Practices Act, N.C. Gen. Stat. § 90-625 et seq.

If at any time during your massage or bodywork treatments you feel uncomfortable or believe your therapist’s words or actions to be inappropriate, you have the right to request an immediate stop to the activity you find objectionable, to end the treatment, or to request a modification of the treatment regardless of any previous consent that you may have previously provided.

You understand that your therapist will instruct you to disrobe to your level of comfort and that it is always your choice to act.

You should communicate with your therapist about any discomfort that you may experience during a massage or bodywork treatment.
You understand that our employees and therapists will treat you respectfully, and you will be expected to treat all The Now™ employees, therapists and other guests with a similar respect.
Our employees and therapists will not tolerate behavior or comments that may be considered threatening, offensive, sexually suggestive, or otherwise inappropriate; this type of behavior is strictly prohibited. Our therapists reserve the right not to treat any client so long as their refusal to treat is lawful and non-discriminatory.
You understand and acknowledge the terms under which your treatment is being provided and you voluntarily agree to receiving such treatment. You have a right to refuse, modify or terminate treatment regardless of prior consent given, and The NOW™ will respect your right to refuse, modify or terminate treatment regardless of prior consent given.

Cancellation. In addition to those cancellation reasons provided in The NOW™ Terms of Service, you shall also have the right to cancel services and receive a prorated refund on unused Services in the following circumstances:
You relocate. If you relocate more than 8 miles from The NOW Studio (which is your studio of original enrollment), and more than 30 miles from The NOW Studio’s facility and any substantially similar facility that will accept your obligation under the contract, then you may cancel this Agreement without penalty and receive a pro rata refund for any prepaid sums.
The NOW Studio Where You Originally Enrolled Relocates or Services are Materially Impaired. If The NOW Studio where you originally enrolled as a member relocates its facility more than 8 miles from its present location, or the services provided by The NOW Studio are materially impaired, then you may cancel this Agreement without penalty and receive a pro rata refund for any prepaid sums.
